Transparent Clock for macOS

These Terms of Use apply to Transparent Clock, a macOS application developed by Nexus Technology Consulting. Transparent Clock is a customizable desktop clock utility that includes optional Pro features made available through Apple's in-app purchase system.

If you download Transparent Clock through the App Store, your use of the app is also subject to Apple's App Store terms and the Apple Standard End User License Agreement. These Terms are intended to supplement those platform terms with app-specific conditions. If a mandatory Apple term conflicts with these Terms, the Apple term will govern to the extent required.

1. License and Permitted Use

Transparent Clock is licensed, not sold, to you. Subject to these Terms and any applicable App Store rules, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded devices that you own or control.

You may not:

  • Copy, resell, sublicense, rent, lease, or distribute the app except as permitted by applicable law
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app except where such restriction is prohibited by law
  • Modify the app or create derivative works from it except where permitted by law or open-source license terms that apply to included components
  • Use the app in a way that interferes with the service, systems, or rights of others

2. App Functionality

Transparent Clock is provided as a desktop utility for displaying time with customizable visual styles, chimes, accessibility options, and optional Pro upgrades. We may add, remove, improve, suspend, or discontinue features at any time as part of updates, bug fixes, compatibility work, or product changes.

Important: Transparent Clock is a convenience utility only. It is not designed for emergency, life-safety, industrial, navigation, medical, or other mission-critical use where delayed, incorrect, or unavailable time information could result in harm.

3. Pro Features and Purchases

Certain features may require a separate Pro purchase. Prices, availability, and feature packaging may vary by territory and storefront. All purchases are processed through Apple, and purchase restoration and entitlement management may also rely on RevenueCat.

We do not store your payment card details. Billing, refunds where available, and other purchase rights are governed by Apple's policies and the terms of the storefront through which you acquired the app.

4. Privacy and External Services

Core settings are stored locally on your device. If you access optional Pro purchase flows, the app may communicate with Apple and RevenueCat to load offerings, validate purchases, and restore entitlements. Please review our Privacy Policy for more detail about how purchase-related information is handled.

5. Your Responsibilities

When using Transparent Clock, you are responsible for:

  • Keeping macOS and your device security settings reasonably up to date
  • Verifying that your device time, timezone, audio output, and notification preferences are configured the way you expect
  • Maintaining access to your Apple ID and purchase history if you want to restore paid features
  • Using the app only in ways that comply with applicable law and platform rules
  • Maintaining appropriate backups and safeguards for your own device and data

6. No Warranty

To the fullest extent permitted by law, Transparent Clock is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.

We do not warrant that the app will always be available, error-free, compatible with every device or configuration, or suitable for your particular needs.

7. Limitation of Liability

To the fullest extent permitted by law, Nexus Technology Consulting and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or device functionality arising from or related to your use of, or inability to use, Transparent Clock.

Nothing in these Terms excludes rights that cannot be excluded under applicable consumer law. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

8. Updates, Suspension, and Termination

We may release updates, patches, compatibility changes, or feature adjustments at any time. We may also suspend or discontinue the app or any feature where reasonably necessary, including for maintenance, legal, security, or product reasons.

Your rights under these Terms automatically end if you materially breach them. Upon termination, you must stop using the app and remove it from your devices.

9. Governing Law

Except where mandatory law provides otherwise, these Terms are governed by the laws of Australia, and you agree to submit to the non-exclusive jurisdiction of the courts of Australia for disputes arising out of or relating to these Terms or your use of Transparent Clock.

10. Enforceability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
